05/13/2014. Who Built & Detonated the Bombs?
FBI Special Agent John Walker testifies today in the 3 friends hearing the Marathon Bombs were detonated remotely. This contradicts information the Tsarnaev brothers obtained their simple bomb-building instructions by down-loading the online INSPIRE magazine instructions--the infamous "How to make a bomb in the kitchen of your mom." So, which is it? Were they lucky first-timers or were they trained in more sophisticated techniques by someone else? Or perhaps they were not the actual bomb-builders? Or even, maybe they didn't know they were carrying live bombs? (The list of possible questions is mind-boggling.)

03/30/2014. The Defense Strategy: Get enough evidence to force a trial
The defense is being deferential to the point of prostrating themselves before the prosecution, the judge and the government agencies, offering a contorted logic to get evidence of a prior relationship between Tamerlan and the FBI and essentially to force LE to admit they lied. They are being very careful not to call LE liars, but if there is any admission whatsoever of prior contact with Tamerlan and his family -then the implication is clear. What is crucial here is whether the defense has something that can be dropped in court that says unequivocally there was prior contact. That would be a bombshell in and of itself - but what could prove to be "nuclear" is whether they have something or someone that points to clear evidence they recruited AND employed him for some time. Listen to the family pronouncements from the very first day - "the FBI has been in contact with him for 5 years", "they have monitored him", "set-up" - "he wasn't supposed to die" - " this wasn't supposed to happen this way." It would be an enormous risk to have asked for this evidence without already knowing it exists. It would be a shrewd calculation to ask for it, if you already have evidence that contact, recruitment and employment occurred. The defense could very well be offering a way for the government to back itself out of a lie with some degree of grace.
The defense rational for obtaining this information is contorted to say the least. How would FBI recruitment "cause" Tamerlan's mental health to "decline"? How could he interpret that in a way to compel him to murder? How could FBI recruitment show Tamerlan's mental health declined as a result "descending into Jihadi madness" - but not so much that he had the capacity to formulate a complex plan and carry it off with steely resolve and without his wife knowing about it or any of his friends. How would this evidence become the "building blocks" for a life affirming mitigation defense? This approach it seems to me - is being very careful not to embarrass or threaten LE and cause them to tie everything up into matters of "National Security" or some such nonsense - and/or in any way put DT at risk.
Everything the family has been quoted as saying all points to evidence of a relationship with LE at some level. At the very least - the family believes it was in relationship with LE and they clearly are not afraid to talk about. What has LE tried to do from day one? They have tried to eliminate all evidence of outside relationships. They have systematically eliminated or silenced any or "friend of a friend" relationships that could in anyway contradict the official narrative. It would seem then the defense strategy is simply to unearth enough evidence that forces the case to trial because if they can make it to trial - they will have leverage to negotiate a plea. Judging from the aggressive behavior of LE, and the stalling of the prosecution - there does not seem to be any compelling urgency to get this to trial. Thus, the defense must engage in a deferential approach because the only one who has the vast majority of evidence is the government. The defense can only hope to coax out as much as it can using mitigation, public pressure and what little evidence they have either as a bluff or as a very real threat to the government case.
Let's face it; if the headlines read - DT is alleging "Tamerlan was recruited, set up and murdered and I have the proof" He would be a monumental threat to the state - and that just doesn't turn out well for most folks. It seems to me this salvo by the defense is a deliberately calculated threat to let the prosecution know "we" have a card or two and we are not afraid to use it. I think this move and future moves are and will be calculated to generate as much pressure on LE to either "give" information and a fair trial, OR "give" a fair plea deal. Because - if any of the conspiracies, rumors, or evidence of a prior relationship is true - there will be a huge backlash - a dangerous backlash they are not prepared to handle.
It is a very public - but veiled game of 3 dimensional chess that we are seeing being played out. Look how much public awareness has been generated by these motions. Google the number of articles generated by this small step into conspiracy land. It has generated thousands and thousands of articles and comments already and growing by the minute. I bet even public officials have got to be getting nervous. The social techs/media/polling gurus are seeing the "public mind" eat this up like candy - and the prosecution cannot afford to let it continue.

Does the Watertown Police Scanner verify a photo taken at the Laurel & Dexter Shootout with the Tsarnaevs? Scanner suggests there were at least 3 individuals seen that night by Law Enforcement. And only one wore a hoodie. Was there also a 4th suspect sporting a blue X-mas hat with a snowflake--a dark-skinned, clean-shaven, middle-eastern man? Did the Tsarnaevs act alone or not? See here.
